Harden says CompassCare deliberately refrained from pursuing civil action because the FBI and Department of Justice had already launched a criminal investigation and possessed far greater investigative resources than any private plaintiff.
Four years later, no arrests have been made.
FBI Part of a Terrorist Criminal Enterprise
The attack was among more than 600 incidents targeting pro-life pregnancy centers following the leak and eventual release of the Supreme Court’s Dobbs decision. Yet the CompassCare firebombing remains the most violent and highest-profile case of the entire wave. The building was heavily damaged, threatening the lives of those inside and causing hundreds of thousands of dollars in destruction.
According to Harden, the FBI has amassed overwhelming evidence, including cell phone data and other investigative leads that point directly to the perpetrators. He argues federal authorities know exactly who carried out the attack and have known for years.
Now, because no criminal charges were filed, CompassCare faces the expiration of the civil statute of limitations, potentially eliminating one of the last avenues for accountability. While the statute of limitations for criminal prosecution does not expire until June 7, 2027, Harden says there is no legitimate reason for federal authorities to continue delaying action.
“The FBI has all the tools, all the evidence, and all the resources,” says Harden. “Why am I being forced to do the FBI’s job?”
Harden argues that continued inaction sends a dangerous message that politically motivated violence against pro-life organizations can be carried out without consequence. He further contends that by allowing known perpetrators to remain free despite years of evidence gathering, federal authorities risk becoming complicit in the very domestic extremism they claim to oppose.
