President Trump’s Final Stand & The Legacy of the U.S. Supreme Court

Intro: With the clock ticking, the President’s path to substantiating his election victory is narrowing. The president’s last hope is litigating the election results before the Supreme Court. On November 20th Chief Justice John Roberts issued a new and surprising order allotting oversight of legal challenges in the states to specific justices. Discussing this curious order is Rick Gates, deputy campaign chairman of the Trump 2016 campaign. 

  1. What state allocations did the Supreme Court recently change? 
  • The Supreme Court, as ordered by Chief Justice John Roberts, made several key changes to the way in which the Court handles election appeals. 
  • Each state is assigned a justice which has oversight for any legal challenges that might arise during a presidential election. 
  • Here are the oversight changes in key battleground states. 

Pennsylvania   –   Justice Samuel Alito

Michigan          –   Justice Brett Kavanaugh

Wisconsin        –   Justice Amy Coney Barrett

Georgia            –   Justice Clarence Thomas

  1. What does this mean for the President’s legal challenges? 
  • It assigns Trump appointed justices to key states that now have oversight for any legal challenges the president presents. 
  • If the president’s legal team submits the evidence it claims it has, the Supreme Court will be compelled to act to determine if ballots in certain states were legal votes. 
  1. What happens next? 
  • Currently, the president has a legal appeal in Pennsylvania with the 3rd Circuit Court. If the outcome is unfavorable, the president’s team will be able to file its first case with the US Supreme Court. 
  • Based on the evidence of voter fraud and other issues, this is the first of several cases that can be submitted to the Supreme Court.
