A Federal Appeals court’s recent decision is a win for private gun owners, according to a Second Amendment spokesperson.
Just shortly after seeing an overturning of a rule surrounding its enforcement on pistol gun braces, the Bureau of Alcohol, Firearms, Tobacco and Explosives (ATF) has been dealt another blow – this time on “ghost guns”.
A federal appeals court recent decided to throw out part of a rule that specifically targeted build-at-home “ghost guns,” believing that the agency’s regulation goes well beyond “limits on agency authority in the name of public policy.”
The ATF, alongside the Biden administration, had been pushing hard to enforce tracking of “ghost guns,” in an effort to crack down on the growing violence within the United States. However, in doing so, the agency’s rules often overcame the protection rights provided to private gun owners by the Second Amendment – and that includes ones built at home.
“ATF, in promulgating its Final Rule, attempted to take on the mantle of Congress to ‘do something’ with respect to gun control. But it is not the province of an executive agency to write laws for our nation. That vital duty, for better or for worse, lies solely with the legislature,” Judge Kurt D. Engelhardt wrote in his decision.
“The Final Rule impermissibly exceeds those limits, such that ATF has essentially rewritten the law.”
While this likely won’t be the last time the ATF tries to act against private gun owners, it’s still a win in their favor.

- The ATF has certainly been hellbent lately on trying to enforce strict restriction on gun owners, particularly with gun braces and “ghost guns.” Why do you think they try to enforce rules well beyond their reach?
- Is “banning” weapons, like the Biden administration so wishes to do, really the answer to solving this violence? You’ve often spoke about the effectiveness of “Concealed Carry,” especially when it comes to “active shooter” events.
- What does this victory over “ghost guns” say to gun groups such as yours, as well as private gun owners?
