Minnesota’s New Gun Control Laws Are Bringing a World of Trouble To Private Gun Owners

A representative for the Second Amendment Foundation explains why this is a pure violation of the rights of those that own firearms.

More and more states are trying to establish their own restrictive gun laws in the face of the Supreme Court overturning New York’s last year – and Minnesota may have the most problematic ones yet.

Per this report from Fox News, the state’s Democratic senators just passed gun control legislation by a narrow vote, with a “red flag law” now in full effect. With it, authorities will be able to go into court with an “extreme risk protection order” to remove a firearm from someone deemed as what they call an “imminent threat.” In addition, expanded background checks will also be introduced for gun transfers.

As expected, gun advocates and groups are up in arms over the new legislation, noting that it violates the rights provided by the Second Amendment. What’s more, it also violates due process as a whole, and could take firearms out of the hands of those that need it the most.

The bill could be signed into law at any moment, but legal action could follow given the rights provided by the Second Amendment.

A representative for the Second Amendment Foundation joins us now to discuss the “red flag law” further, and how it violates the rights of private gun owners.

Q&A:

  1. Why do so many states attempt to make restrictive gun laws knowing that it goes against everything that the Second Amendment of the Constitution provides?
  2. How much of a problem will Minnesota’s restrictive gun laws create for private gun owners and collectors?
  3. Does it seem like a major violation that a court can decide who’s an “imminent threat” with a gun, even if it doesn’t seem like they’re a threat whatsoever?
  4. What do you think about the term “extreme risk protection order”? Does that sound a bit off to you?
  5. What do you think will come of this law over the next few weeks? Will we see legal challenges backed by the Second Amendment? Could Minnesota Democrats respond with a different legal approach?
  6. Where can we learn more about the Second Amendment Foundation and its members?
