Maryland’s Controversial Handgun Licensure Law Is Deemed Unconstitutional

A representative for the Second Amendment Foundation discusses this key court victory.

A U.S. appeals court has once again sided with the gun owners after knocking down a ridiculous law set up by the state of Maryland.

The court decided this past week that the state’s licensing requirements for people seeking to buy handguns is unconstitutional, knocking it down before it could take further effect.

As decided by three judges of the Richmond, Virginia based 4th U.S. Circuit Court of Appeals, the now-defunct law originally required people to undergo training and background checks before applying for licenses to buy handguns. The court believes it completely violated the rights as provided by the Second Amendment in the Constitution.

“Maryland has not shown that this regime is consistent with our nation’s historical tradition of firearm regulation,” U.S. Circuit Judge Julius Richardson noted in the ruling.

  1. First off, how big a victory is this for gun owners, since Maryland will no longer be able to hold tight restrictions against them?
  2. It seems that several states have tried to pass restrictions on guns, in some form of another. Are they really that concerned about gun violence in their state, and just feel there’s no other solution?
  3. Why don’t states realize that a majority of these rules go up against the Second Amendment of the Constitution? Not enough research? Or are they just seeing what sticks after they throw ideas on the wall?
  4. Do you believe more states will try to pass certain restrictions as the new year approaches?
