Hawaii’s Complete Disregard For the Second Amendment Could Prove Costly To Private Gun Owners

A Second Amendment Foundation spokesman explains why the state’s violation of the Constitution could prove costly.

When did Hawaii suddenly think that the Constitution didn’t apply to them?

According to this report from Newsweek, the state is completely ignoring the Second Amendment rights of a citizen who was carrying a gun in public without a permit provided by the state. 

Initially, the man wasn’t to be charged, as decided by a lower court ruling. However, the state’s Supreme Court has now stepped in, noting, “We reject Wilson’s constitutional challenges. Conventional interpretive modalities and Hawaii’s historical tradition of firearm regulation rule out an individual right to keep and bear arms under the Hawaii Constitution. In Hawaii, there is no state constitutional right to carry a firearm in public.”

What’s more, the Hawaii Supreme Court noted that the Second Amendment uses “military-tinged language – ‘well-regulated militia’ and ‘bear arms’ – to limit the use of deadly weapons to a military purpose.”

To interpret what the Second Amendment stands for is one thing. But to use it with a state policy that could very well see someone jailed is another.

  2. Doesn’t it seem a bit concerning that a state government isn’t just ignoring the rights provided by the Second Amendment, but also question what it stands for in the first place?
