Untouchable No More: Major GOA Lawsuit Victory; Gangster-Era Law that Outlived Gangsters Suddenly on Firing Line
For nearly 100 years, the National Firearms Act (NFA) has imposed federal regulations that were originally intended to combat the gang violence of the Prohibition era. Sparked in large part by the rise of Al Capone and other organized crime figures, the law has instead become a fixture of everyday life for millions of law-abiding gun owners, making their lives unnecessarily difficult. Second Amendment champion and GOA spokesman Stephen Willeford says a landmark federal court ruling may have put that century-old framework on its weakest constitutional footing since it became law in 1934.

In a major victory for plaintiffs, the Gun Owners of America (GOA) and its allies, a federal judge in Texas ruled that key provisions of the National Firearms Act are unconstitutional as applied to suppressors, short-barreled rifles, and short-barreled shotguns. The decision does not rest on the Second Amendment itself. Instead, the court concluded that Congress eliminated the constitutional foundation for those regulations when it reduced the NFA’s transfer and making taxes on those firearms to zero dollars.
According to the court, the NFA was enacted under Congress’s taxing authority, with its registration requirements, fingerprinting, photographs, approvals, and other regulatory burdens designed to administer and enforce that tax. Once Congress eliminated the tax, the court found that the constitutional justification for those regulations disappeared as well. The judge also rejected the government’s attempt to preserve the law by relying on the Commerce Clause, concluding that Congress never enacted those provisions under that authority.
The ruling is limited in scope and is expected to be appealed, but it raises an extraordinary possibility: that a law approaching its 100th anniversary could ultimately be dismantled because it no longer rests on the constitutional authority that created it. If upheld through the appeals process, the case could fundamentally reshape federal firearms regulation and become one of the most consequential gun-rights decisions in decades.
