The attempt by California and Giffords to stop the production of ghost guns has been thwarted by a federal appeals court.
When it comes to California and the Giffords gun control advocacy group trying to stop “ghost guns” from being made, it appears their challenge didn’t stand a ghost of a chance. And that’s a victory that Gun Owners of America spokesman Stephen Willeford is very pleased with.
- A federal appeals court threw out a lawsuit filed by the Giffords gun control advocacy group and the state of California over the production of what they deem illegal “ghost guns.”
- The decision was unanimous, and the judge noted how neither party could sue on “speculation” about the harm being done by components.
- This marks the latest legal victory for pro-gun advocates over the past week, following the reversal of the long-standing NFA registration rule.
Right before the weekend, a federal appeals court threw out the lawsuit made by the state and the group, who attempted to say that Biden’s administration-era rule to cease the production of largely untraceable, independently produced “ghost guns” should be more strict.
After a lower court previously ruled in their favor, the 9th U.S. Circuit court of Appeals in San Francisco voted unanimously to dismiss the suit, stating that neither the state nor Giffords could sue based on “speculation” about the harm from components of said “ghost guns,” which could be created from components.

This comes just four days after U.S. District Judge Reed O’Connor of Ft. Worth, Texas noted Biden’s rule as going directly against the Second Amendment – the Constitutional right for everyone to bear arms.
Neither California attorneys nor any Giffords representatives had anything to say regarding the decision, though there could be a chance they try to revisit it again from a different angle.
