A Second Amendment Foundation representative says the decision is one that champions the rights of U.S. citizens.
This past weekend, the judge has knocked down a federal law that prohibited marijuana users from possessing firearms, deeming it unconstitutional. This follows the move by the Supreme Court the prior year to expand gun rights to people in the United States.
Simultaneously , U.S. District Judge Patrick Wyrick dismissed an indictment against a man who was charged in August with going up against this ban.
He noted that possessing or using marijuana was “not in and of itself a violent, forceful, or threatening act,” and that Oklahoma was a state where it was legal to use it for medicinal purposes.
“The mere use of marijuana carries none of the characteristics that the Nation’s history and tradition of firearms regulation supports,” he noted.
The U.S. Department of Justice will likely appeal the decision, though it hasn’t been filed just yet.
With us now to discuss this further is a spokesperson for the Second Amendment Foundation, a group that firmly believes in the right for citizens to bear arms. Their expertise will be useful in this matter.

- Why do you think the U.S. Department of Justice created a ban on marijuana users possessing firearms to begin with?
- Do you believe there may have been concern with someone using a firearm while being high on marijuana? Does this really pose as much of a danger as the Department of Justice believes?
- Considering that many use marijuana for medicinal purposes, does the ban really make sense as far as they’re concerned?
- This ties in with other bans that other states are trying to put in place, such as New York and Illinois, in response to the Supreme Court loosening gun laws last year. Do you believe these will be effective in the long run, or no?
