Chemical Counterattack: CEO Pushes Congress to Empower Injured Women to Pursue Reparations

What if women harmed by chemical abortion could stop being treated merely as victims, and start pursuing the companies and providers they say caused their injuries? Jim Harden, CEO of CompassCare, is pushing that question into the national debate as Congress considers legislation that would create a private right of action for women harmed by mifepristone.

  • Women injured by chemical abortion could gain new legal avenues.
  • Hawley’s legislation would create litigation options for women claiming mifepristone injuries.
  • Harden says accountability should extend throughout the chemical-abortion industry.
  • Personhood legislation would extend constitutional protections from fertilization through natural death.
  • Legal action could give injured women a stronger voice.

Sen. Josh Hawley’s Safeguarding Women from Chemical Abortion Act would withdraw FDA approval of mifepristone for abortion and allow women injured by the drug to sue its manufacturers for damages. Hawley has also highlighted testimony from women who described serious complications after taking mifepristone, including hemorrhaging, infection and extended hospitalization.

Harden believes litigation could become a powerful avenue for women who contend they were injured after being assured chemical abortion was safe, easy or adequately supervised. His newly proposed Personhood Clarification Act language represents another piece of his broader effort to address abortion through federal law, but the immediate legal question is more direct: If women suffer serious injuries, what avenues should they have to hold the manufacturers and providers accountable?

That question takes on added significance as chemical abortion has become increasingly accessible through remote prescribing and shipment. Hawley has specifically argued that women harmed by mifepristone currently lack a meaningful avenue to recover damages from the companies that manufacture the drug, and his legislation is designed to change that.

Harden can discuss what a litigation-based strategy could mean for women who believe they were harmed by chemical abortion, what evidence such cases could involve, and whether expanding liability could force greater transparency and accountability throughout the chemical-abortion industry. He can also explain why he believes Congress should address not only the availability of the drugs, but the legal recourse available to women who suffer injuries after taking them.
