A Federal Judge’s Reversal On a Controversial California Gun Law Is a Major Win For Gun Rights

A representative for the Second Amendment Foundation explains why Gov. Newsom’s restrictive gun law never stood a chance against the Constitution.

On January 1st, Gov. Gavin Newsom’s controversial Senate Bill 2 was set to go into effect across California, restricting the rights of Concealed Carry (or Constitutional Carry) citizens by keeping them out of a number of public faces. But it appears that isn’t so much the case anymore.

A federal judge recently knocked down a number of parts of the bill, deeming it as unconstitutional. Hence, it more than likely won’t take effect in the new year.

U.S. District Judge Cormac J. Carney noted that the law’s “coverage is sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court.”

While this likely won’t be the last we’ve heard from Newsom and his efforts to keep his state gun-free, this is a major win for those that celebrate gun rights, as well as those that are licensed for Concealed Carry.

A representative for the Second Amendment Foundation joins us now to discuss the matter further.

  1. Why is it that states seem to set up these gun restrictions that go up against the rights provided by the Constitution, namely the Second Amendment?
  2. Did Gov. Newsom simply not take the Second Amendment into consideration when he set up his latest gun bill? Is he really that determined to keep guns out of his state?
  3. We’ve seen, in the past, restrictive gun laws that fail to quell the violence happening within these states. Why do you believe that is?
  4. With this latest decision, will Gov. Newsom perhaps consider a different take on gun restrictions with another law in 2024? Or will he simply try to revise this one?
  5. Do you see other states trying to introduce similar laws with the new year? 
  6. Why do you think more states aren’t considering Concealed Carry as a viable option against “active shooter” events?
