Pill of Rights: Supreme Court Justice says Big Pharma’s ‘Criminal Enterprise’ Unaccountable

The Supreme Court’s latest ruling on mail-order chemical abortion drugs is exposing a much bigger issue than abortion politics. In a blistering dissent, Supreme Court Justice Clarence Thomas accused pharmaceutical companies seeking continued distribution of mifepristone of participating in what he called a “criminal enterprise.” Thomas argued that shipping abortion pills through the mail violates the federal Comstock Act and undermines state abortion laws.

For those keeping score at home, that means a Supreme Court Justice identified Big Pharma as engaging in a criminal conspiracy.

“Applicants are not entitled to a stay of an adverse court order based on lost profits from their criminal enterprise,” Thomas wrote — extraordinary language from a sitting Supreme Court justice directed at powerful pharmaceutical interests.

The Court majority nevertheless stayed the 5th Circuit’s ruling that would have halted the FDA’s 2023 deregulation of mail-order abortion drugs.

Harden says the implications extend far beyond abortion.

“This is about whether federal bureaucracies are accountable to the law at all,” Harden argues. “If agencies can selectively ignore federal statutes, sidestep state authority, and delay drug safety reviews because of politics, every American should be concerned.”

The controversy comes amid growing scrutiny over chemical abortion safety. Recent data suggests roughly one in ten women experience serious complications requiring emergency care after taking abortion pills. Justice Samuel Alito also revealed in his dissent that FDA officials allegedly delayed a promised safety review of mifepristone for at least six months.
