Intro: Kamala Harris was a District Attorney from California and the 9th Circuit Court of San Francisco was considered by many to be the most liberal appellate court in the United States. So, how on earth did this San Francisco court just issue a huge pro-gun ruling?
The 9th Circuit Court of Appeals, based in San Francisco, shocked court watchers by ruling that California’s ban on “large-capacity gun magazines unconstitutionally violates the 2nd Amendment. Such a ruling from this particular court as the election season heats up will undoubtedly put additional focus on the views of both Democratic candidates, but especially Kamala Harris.
While not a 2nd Amendment Foundation case, their contributions to the amicus brief, along with many other organizations, are reflected in the majority opinion written by Circuit Judge Kenneth K. Lee. His ruling recognized the “laudable goal” of a law which basically “infringes on the fundamental right to self-defense.”
SAF President Alan Gottlieb noted that “the court went into considerable detail about the history of magazine development and essentially follows the logic of our amicus, for which we are all very proud.”
Heightened scrutiny will be the order of the day for Republican strategists looking to box in Kamala Harris on her previous statements and pursue her reaction to the a ruling about a law from Sen. Harris’ home state and a ruling from a court she is all too familiar with.
- Will this pro-gun ruling up end on appeal in the Supreme Court?
- How does this ruling stack up against other lawsuits on federal or state gun control laws?
- Were you shocked by the ruling and the face Judge Lee wrote the majority opinion? And why is the 9th Circuit Court of Appeals in San Francisco seeming so conservative now?
- Senator Harris has radical views on gun control and even talks about using Executive Action to basically confiscate weapons, can a President legally do that?
- What other states have similar laws that might be effected by this ruling?
- Even with everything else going on, so you think the fight for gun control will start to come up as a major election issue?
- Should the Republicans start hammering on gun control now that the Democrats have put a far-left radical on the ticket?
