Intro: The United States Supreme Court affirmed that employers may not discriminate on the basis of someone’s sexual orientation. Will this new decision clash with religious rights enshrined in the First Amendment? Will it force Christian Bakeries to cater to same-sex weddings? Joining us in this discussion is Chaplain Gordon Klingenschmitt.
1. What does this 6-3 decision by the Supreme Court really mean?
Title VII of US Code applies to discrimination on the basis of the term “sex” to male-female hiring decisions, but now that includes LGBT employees whose status is technically not the same as sex but the court is treating them the same for hiring and firing decisions by employers. However Justice Gorsuch was clear this does not apply to accessing opposite gender bathrooms, and it does not yet allow boys to compete in women’s sports, which violates Title IX equality in sports funding.
2. Will this Supreme Court decision apply to churches?
No. The First Amendment still protects Churches and religious institutions in their hiring decisions as it pertains to their inherently religious functions.
3. Will this Supreme Court opinion affect religious employers, like Catholic schools or Christian bookstores?
Probably not, but that’s unclear. The three cases involved a Skydiver, a funeral director, and a county judicial system employee, but not a Christian employer per se.
4. Will this decision affect Christian bakers, photographers, and florists who don’t want to perform gay weddings?
No. In the Masterpiece Cake Shop case from 2018 about the Christian baker in Denver the Supreme Court ruled 7-2 that governments may not be hostile to Christian business owners, and Christians don’t have to participate in gay weddings.
5. You were a Navy Chaplain, how will this decision affect the military?
It doesn’t yet affect the military, but it will be cited by transgender activists as a reason to allow men to wear women’s uniforms in the military. The Trump Administration has disallowed the recruiting new unstable gender-changers into the military, but has not fired transgender military members who are grandfathered in.
