The Supreme Court just made a major decision surrounding gun rights for marijuana users – and here’s why it matters.
The Second Amendment of the Constitution provides everyone the right to bear arms, although there are some states that argue that this simply shouldn’t be the case. Regardless, it still remains in place, and the Supreme Court just reminded the federal government of its importance. And that certainly has the attention of Gun Owners of America spokesman Stephen Willeford.
- The Supreme Court recently decided in favor of Ali Danial Hemani, a frequent marijuana user who was indicted on a single count of violating the federal anti-guns-and-drugs law back in 2023.
- Justice Neil Gorsuch explained that the Second Amendment provides protection over U.S. citizens – even casual drug users.
- The decision could halt the federal government from proceeding with similar cases against drug users.
The Supreme Court decided today that the federal government has no right to take away the gun rights from a frequent marijuana user, putting future prosecution around such cases into question.
Ali Danial Hemani was indicted back in 2023 on a single count of violating the federal anti-guns-and-drugs law. But the Court ultimately decided in his favor, with Justice Neil Gorsuch explaining that the charge was acting against what the Second Amendment stood for.
“We do not question that sometimes an individual’s unlawful use of marijuana (or any other controlled substance) may render him a danger to others,” the court statement read. “But, again, the government disclaims the need to show anything like that in this case. Instead, it asks us to conclude that anyone who regularly uses marijuana is categorically violent and dangerous without any further showing.”
With that, Gorsuch found their actions unfair and found in favor of Hemani.
While this is clearly a win for those that believe in the power of gun rights, others are asking questions, such as whether casual drug users should have access to weapons when they’re not in the right frame of mind.
Steve Vladeck, a Supreme Court analyst for CNN, noted, “The court seems to have gone out of its way to avoid deciding any bigger questions about whether it’s constitutional to criminalize gun possession by drug addicts; by individuals who are actually intoxicated; or in other circumstances in which the defendant is not obviously dangerous.”
Willeford, who was the 2017 “hero with a gun” in an event taking place in Sutherland Springs, joins us now to discuss the situation further. We welcome him to the show!

- Do you believe people should have access to guns if they utilize drugs that could manipulate their way of thinking? Or should some sort of training be necessary?
