U.S. District Court Judge  Duplicates Antifa Arguments to Allege Constitutional Abortion Rights (Guest: Jim Harden)

Abortion battles continue in the United States. One U.S. District Court Judge has adopted an illegitimate approach to enshrine abortion as a Constitutional right.

Colleen Kollar-Kotelly, who serves in Washington D.C., has turned to the Constitution for her argument – namely, the 13th Amendment. “When women are compelled to carry and bear children, they are subjected to ‘involuntary servitude’ in violation of the thirteenth amendment,” she noted from Andrew Koppelman’s paperForced Labor: A Thirteenth Amendment Defense of Abortion.

However, as the Dobbs case notes, “The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives.”

The 13th Amendment is in place to prevent an individual or government entity from dehumanizing a person or class of people. The occasion for the ratification of the 13th Amendment was to outlaw slavery, solidifying the full and equal personhood of all human beings. 

Kollar-Kotelley’s argument aligns with the rhetoric of Jane’s Revenge, an Antifa-connected domestic terrorist group that has been responsible for the firebombing of multiple pregnancy centers, including a CompassCare location in Buffalo, injuring two firefighters. CompassCare Jim Harden noted in a press release over the matter, “Perhaps the founders and authors of the 13th Amendment did envision abortion, but not in the way the Judge suggests. The 13th Amendment outlaws the denial of personhood to any class of person. And since abortion, like slavery, exists as refusal to recognize the personhood of a category of human, far from making abortion a right, the 13th Amendment precludes it.”

Rev. Harden also added, “The pro-abortion crimewave against pro-life people is ignored by the DOJ.Politicians are moving to criminalize pro-life activity. And now a federal court judge uses Antifa servitude arguments to protect abortion in order to indict pro-life people of conspiracy to deprive women of their right to abortion. How deep does the Marxist Antifa rabbit hole go into the ranks of America’s political elite? Can the Democratic Republic survive the breach?”

  1. What do you think the biggest problem is with U.S. District Judge Kollar-Kotelly’s recent statement surrounding abortion?
  2. In your press statement, you noted that Kollar-Kotelly’s beliefs match up with that of Jane’s Revenge. In what way, and is it something that her superiors should take notice of?
  3. What do you think about Kollar-Kotelly’s use of the term “involuntary servitude” when it comes to a pregnancy? Does carrying a baby to term have value for the mother beyond her personal opinion or evaluation?
  4. Could others – perhaps Kollar-Kotelly’s peers – consider a similar argument as they try to move forward with their argument on abortion?
  5. Where do you see the battle over abortion going over the course of the year, particularly a Republican Congress?
