The Supreme Court Refuses to Listen to Gun Retailers, And It’s a Serious Problem

A Second Amendment Foundation representative explains why the Court’s deaf ear to New York’s strict gun laws could cost gun sellers dearly.

A few months back, New York decided to implement its Concealed Carry Improvement Act, after the Supreme Court had knocked down strict laws it had made beforehand. But now, the Court has seemingly turned its back on retailers that are being hurt by this very act.

The Court recently rejected a bid by various retailers in New York that sell guns, who noted that the new gun laws were violating their Second Amendment rights, along with leaving a notable dent in their sales.

“We are disappointed that not one of the nine justices saw fit to grant the plaintiffs some stay of enforcement of the new laws against them,” Paloma Capanna, the lead attorney for the New York gun retailers, told Fox News Digital earlier this week.

“We are challenging the ability of the state of New York to target dealers in firearms in the lawful stream of commerce, to put them out of business, which is what the new laws will do. So it really was unfortunate to see that we couldn’t get any emergency temporary injunction against those laws.” 


The decision comes after the Supreme Court denied a claim by gun rights activists to block the Concealed Carry Improvement Act, though no reason was given.

Here now to talk about the Supreme Court’s decision – and the effects that come from it – is a spokesman for the Second Amendment Foundation. They believe that everyone should have the right to bear arms, and firmly believe in the right to Concealed (or Constitutional) Carry – especially these days.   1. Does it seem rather odd that the Supreme Court would knock down New York’s previous gun laws, but then turn away complaints surrounding the Concealed Carry Improvement Act?
  2. What do you think prompted the Supreme Court to make such a decision? Could they be concerned about anti-gun advocates bringing up more arguments? Or is it something else?
  3. How do you think this decision will affect both gun retailers and private collectors in the city of New York and its surrounding areas?
  4. Do you believe that other states could implement similar gun laws over the next few months? We’ve already seen some, like Maryland, limit citizens that believe in Concealed Carry.
  5. What advice would you have for gun retailers frustrated by the lack of support from the Supreme Court?
