Gun Owners of America spokesman Stephen Willeford discusses the big legal win over the ridiculous mailing restrictions.
The Department of Justice’s Office of Legal Counsel has made it clear – the United States Postal Service got it wrong when it came to halting the mailing of firearms.
This week, the Department made the decision to call 18 U.S.C. 1715 – a federal statute prohibiting the mailing of concealable firearms including pistols and other firearms – unconstitutional. They believe that the rights for citizens to receive arms are protected by the Second Amendment.
As a result, it has directed the Postal Service to modify current regulations accordingly, and that the statute should no longer be criminally enforced.
This is a huge victory for Second Amendment rights, and a major blow to those that were backing the Postal Service’s unfair ban on mailing firearms.
Erich Pratt, Senior Vice President of Gun Owners of America, noted, “This opinion is a direct rebuke to decades of federal overreach that has unlawfully restricted Americans’ ability to acquire, maintain, and transport their firearms. For too long, law-abiding gun owners have been forced to navigate expensive, burdensome workarounds involving federal firearms licensees, just to ship a handgun—even for perfectly lawfulpurposes. The DOJ now recognizes what we’ve always known: the Second Amendment protects the right to keep and bear arms, and that includes the rights to acquire and transport them.”
