Second Amendment Foundation Spokesman Discusses Enforcement Stay of Warrantless Retailer Searches

The representative of the group explains just how wrong it is for gun shops to be searched without a warrant.

The Second Amendment Foundation recently teamed up with Shot Tec, LLC and private citizen Grant Schmidt to file a case that challenges Pennsylvania’s firearm regulation, and its enforcement by both the Pennsylvania State Police (PSP) and Montgomery County Sheriff’s Office.

The importance of this ties in with Montgomery County Sheriff Sean Kilkenny’s recent agreement to a court-ordered stay of enforcement of this policy, which previously permitted gun shops to be inspected without a warrant. With this stipulation, licensees will not be subjected to warrantless searches while the case progresses.

Second Amendment Foundation Executive Director Adam Kraut spoke on the matter, stating, “We’re delighted that Sheriff Kilkenny has agreed to pull back from enforcing his policy of conducting warrantless searches of licensees.”

SAF founder and Executive Vice President Alan M. Gottlieb added, “It is important that this challenge make its way through the court in a timely fashion.” He also noted that no actions should be taken to suggest this policy is acceptable or will ultimately prevail, since warrantless searches violate the Fourth Amendment in the Constitution.

  1. So why do you believe Pennsylvania introduced this measure surrounding inspecting gun shops without a warrant in the first place? Did they consider it something out of safety, or was it something else?
  2. Does this truly violate the rights of owners of these gun shops, as noted by the Fourth Amendment in the Constitution?
