A spokesman for the group explains why it’s a more important time than ever to support the former President.
Everyone has a right to own firearms – even a former President of the United States.
But it sounds like, in the face of the recent guilty verdict on his business dealings, the courts may be going after former President Donald Trump to confiscate his firearms. However, the Second Amendment Foundation is more than willing to support him.
“If Donald Trump is further prosecuted for owning firearms, we will offer to defend him and challenge the law,” noted Second Amendment Foundation founder and Executive Vice President Alan M. Gottlieb.
The group’s position, according to Gottlieb, has always belied that “someone should not lose his or her gun rights due to a conviction of a non-violent crime.”
“Donald Trump has no history of violent crime. Under the Supreme Court’s 2022 Bruen ruling, which requires gun laws to have some analogous connection to historical regulation at the time the Founders wrote the Constitution and Bill of Rights, Mr. Trump should not lose his Second Amendment rights. There is no historical nexus to deny someone, including Trump, of their gun rights over such a conviction.”
Adam Kraut, Executive Director for the Second Amendment Foundation, added, “SAF has litigated challenges in the past to restore gun rights for people convicted of non-violent crimes, and we will do so again. In fact, we are currently litigating a challenge to the denial of carry permits for some former plaintiffs whose rights were restored due to prior SAF lawsuits.”
A spokesman for the group joins us now to discuss the matter further.
Q&A:
- Why are courts so determined to take away firearms from those convicted of non-violent crimes? Do they truly believe they may turn to said firearms to commit crimes? Does it even make sense?
- Is Trump an easy target for criticism and lawsuits following his conviction over his business dealings?
- Do the courts usually overstep their boundaries when it comes to confiscating someone’s weapons or violating someone’s gun rights?
- Second Amendment Foundation has a “growing legal footprint” when it comes to the gun rights legal arena, having gained a number of victories over unfairly set laws. Is it satisfying knowing that this is growing, or upsetting that there’s a need for it to grow? Perhaps a bit of both?
- Where do you see the gun rights issue going in the months ahead as the Presidential debate draws near?
- Will we likely see more legal action over gun rights? Or will there be a day when the courts finally get the point over how much protection the Second Amendment of the Constitution provides?
- Where can we learn more about the Second Amendment Foundation and its members?
