Second Amendment Foundation Files Appeal Against Case Banning Firearms From Homes of Licensed Day Care Specialists In Illinois (Guest: Second Amendment)

A representative for the group explains why it’s vital that people have the choice to bear arms, especially in today’s climate.

A lower court ruling in Illinois that calls for the ban on firearms for the purpose of immediate self-defense in the homes of adults licensed to provide day or foster care has resulted for an appeal by the Second Amendment Foundation.

Alongside the Illinois State Rifle Association, Illinois Carry and two private citizens – Darin E. and Jennifer J. Miller – the group notes the importance of being able to bear arms, especially in the case of self-defense – something that’s vastly important with several states seeing an increase in crime.

“Our case dates back to before the U.S. Supreme Court handed down the Bruen decision in June of this year,” noted SAF founder and Executive Vice President Alan M. Gottlieb. “The Bruen ruling is fatal to the state’s position that rules allowing this gun ban are constitutional. The Bruen ruling did away with the ‘two-step’ approach to determining Second Amendment-based challenges.”

He added, “This is yet another case of Illinois government trying to perpetuate restrictions on law-abiding gun owners contrary to Supreme Court rulings.”

In the brief, the Second Amendment noted that “modern firearm restrictions must be closely analogous to historical restrictions, and the inquiry into historical analogues does not give the State a regulatory blank check.”

  1. In a nutshell, what do you believe Illinois got wrong with its ruling on banning firearms from the homes of adults licensed to run day care? 
  2. Illinois seems to have a history of passing laws that restrict firearms in one form or another. Are they doing this for protective purposes, or a different agenda?
  3. Does it seem like Illinois is following President Joe Biden’s example when it comes to having a long-term plan to try and eliminate assault weapons? Or is this more of a plan to go after guns in general?
  4. What would your argument be to someone that agrees with the ban, saying, “Firearms shouldn’t be around children anyway”?
