Second Amendment Foundation Files a New Brief In Response To California’s Ongoing “Assault Weapons” Ban

A representative for the group explains why the ineffective ban shouldn’t be in place.

California has been boasting about the effectiveness of the assault weapons ban that it put in place some time ago, despite the fact that “active shooter” events haven’t dropped as much as it was hoping. Now, with reports that the ban could soon be overturned, the Second Amendment Foundation has filed a crucial response brief, making note of its lack of response in an ongoing court case.

SAF founder and Executive Vice President Alan M. Gottlieb noted in a statement, “Our reply takes the state to task for going directly against the instructions of the federal court. The state spent its entire 25-page brief trying to re-litigate the case, essentially arguing for ‘interest balancing’ by the court, which the Supreme Court nixed last year in its landmark Bruen ruling. The only logical conclusion is that the State of California is stalling, trying to delay the inevitable ruling that the ban on semiautomatic rifles is unconstitutional.”

Several plaintiffs noted in their brief that the state is “simply padding the record with old (and misplaced) arguments and extraneous declarations” in regards to the gun ban.

Regarding California’s ongoing argument about safety from this ban, Gottlieb added, “The court shouldn’t tolerate such legal shenanigans, which ultimately attempt to reframe this case into a policy matter, which boils down to whether average citizens ‘need’ a semiautomatic firearm.”

Now, with the Second Amendment of the Constitution in place, the Foundation, alongside several other gun advocate groups, could see the ban overturned.   1. Why do you think representatives for California is stalling instead of effectively trying to prove that the gun ban is good for the state?
  2. Considering that the number of “active shooter” events haven’t really gone down with the gun ban, why do you think state reps aren’t looking at other options?
  3. For the longest time, groups such as the Second Amendment Foundation have argued about the effectiveness of Concealed-Carry or Constitutional-Carry, as some call it. Why do you think this would have greater results than an all-out ban?
  4. Do you think President Biden and his administration should look at how ineffective the California “assault weapons” ban was before continuing with their argument, if this doesn’t force them to drop it entirely?
  5. Do you see other states possibly not considering gun bans in their states given the stature of the Second Amendment of the Constitution? Or will they continue to try and find a way around it?
