Second Amendment Foundation Begins Its Case Against the ATF

The group’s attorney, Matthew Larosiere, will present the group’s case this week.

For far too long, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) have been partaking in activities surrounding firearms that have violated the Second Amendment rights of private gun owners. Now, the Second Amendment Foundation is ready to fight back.

Attorney Matthew Larosiere, who serves as a scholar of law and policy for the group, will present their case today with the House Committee on Oversight and Accountability, under the name “ATF’s Assault on the Second Amendment: When Is Enough Enough?”

When asked for the reasoning for this case, SAF founder and Executive Vice President Alan Gottlieb explained, “Under Joe Biden, the ATF has been weaponized against law-abiding citizens, and his new budget proposal includes $1.9 billion for the agency to expand operations and increase regulation of the firearms industry.”

He added, “We’re proud to have Matt offering insight to the House committee.”

SAF Executive Director Adam Kraut added, “ATF has been known for its institutional abuse of power throughout history. Now, more than ever, the agency is being weaponized as a means to punish peaceable gun owners and drive small businesses out of the marketplace by inventing creative statutory interpretations surpassing the agency’s authority and scrutinizing federal firearms licensees every actions in a ‘gotcha’ manner.”

Q&A:

  1. Would you say that the ATF’s interests are aligning with Biden’s steps to try and get “assault weapons” bans outright, using an inflated budget to increase their enforcement?
  2. How is the ATF violating the rights of citizens? By looking into their gun purchases? Exploring their private history? Or a number of these things?
  3. What do you hope that Larosiere and the Second Amendment Foundation look to prove during this hearing with the House Committee on Oversight and Accountability?
  4. Where do you see the battle over gun rights going in the months ahead? Will Biden likely “double down” and continue to try to fund the ATF? Or will there finally be enough convincing for Congress to guarantee the rights of gun owners, per the Second Amendment?
  5. For the longest time, you’ve been talking about Concealed-Carry, or Constitutional-Carry as some call it, being a more viable solution to “active shooters” rather than an all-out gun ban. Why do you believe this is the case, and why isn’t Biden on board with it?
