New York’s Controversial Law Affecting Pregnancy Care Centers

CompassCare CEO Jim Harden explains why this could be a big problem in the ongoing battle over abortion.

Can you mandatory quotas requiring Italian chefs to be hired to cook Indian food? Or, if you want to go a little deeper, Democrat politicians forced to hire Republican speechwriters? Seems ridiculous, doesn’t it? And yet, a New York law could soon force pro-life pregnancy care centers to employ pro-abortion staff, or face huge fines and lawsuits as a result.

In 2009, fearing a decision that would overturn Roe v. Wade, New York created a bill that would deregulate abortion, making it a fundamental human right through all nine months of pregnancy. As part of that, the legislature also made it illegal for anti-abortion groups to refuse to hire pro-abortion staff.

The law, which could set a dangerous precedent if it continues the way it is, is currently being challenged in the U.S. Second Circuit Court as of December 14, 2023. Alliance Defending Freedom (ADF) is working alongside CompassCare Pregnancy Centers on a lawsuit, CompassCare v Hochul, following its dismissal in a lower court.

By potentially refusing to hire said employees, pregnancy care centers, like CompassCare, could face expensive labor discrimination lawsuits, creating a threat to said centers – and at a time when the battle over life is at its most crucial.

That said, this “Boss Bill,” as it’s being deemed, actually attacks the First Amendment, including violating religious employers’ freedom, freedom of speech and freedom of association. Every employer has the right to this, no matter the case. If the law continues to stand, it will allow the government to possibly force other groups to hire those that wouldn’t normally fit in their establishment – like hunters working for animal rights groups.

Joining us now to discuss the case further is Jim Harden, CEO of CompassCare. He’s been fighting in court all this week over the matter and explains why it’s such a vital fight right now.
