The confirmation battle over Todd Blanche has produced one of the strangest political spectacles in recent memory, according to CompassCare CEO and President Rev. Jim Harden, who argues that Washington is pretending to solve a problem that Congress already addressed seven decades ago.

As Senators John Cornyn and Tom Tillis conditioned their support for Blanche’s confirmation on his promise to rescind the Treasury Department’s $18 billion Anti-Weaponization Fund, Harden says the entire exercise is little more than political theater. His central argument is straightforward: Blanche cannot rescind a fund that Congress created, because only Congress has the constitutional authority to repeal or eliminate it.
“This is one big sham and show, for some reason,” Harden says.
Harden contends that the controversy becomes even more puzzling when viewed alongside the federal Judgment Fund, a permanent appropriation established by Congress more than 70 years ago to pay certain judgments and settlements against the United States. In his view, the Judgment Fund already serves the very purpose the Anti-Weaponization Fund was ostensibly created to fulfill, making the newer fund unnecessary while exposing a fundamental misunderstanding of constitutional authority.
“Cue the circus music,” Harden says. “The senators demanding Blanche eliminate the fund are the very people who possess the legislative authority to repeal it.”
Rather than focusing on an executive branch official who lacks the power to erase a congressional appropriation, Harden argues lawmakers should be debating whether the fund should exist at all—and, if not, introducing legislation to abolish it. Conditioning an Attorney General confirmation on a promise that cannot legally be fulfilled, he says, illustrates a troubling disconnect between constitutional responsibilities and political messaging.
