Once more, private gun owners and sellers are under attack. And once more, Gun Owners of America are doing something about it.
The group, alongside Gun Owners Foundation, have filed a lawsuit with Texas Attorney General Ken Paxton challenging a new Pistol Brace Ban put into effect by President Joe Biden and his administration. It was filed in the U.S. District Court for the Southern District of Texas late last week.
The rule took effect just last month, calling for a ban on unregistered possession of pistols with stabilizing braces. The problem, however, is how it has inconsistencies with the Second Amendment, which protects American citizens’ right to keep and bear arms.
In the suit, detailed here, Gun Owners of America argues that the new rule will force Americans to either register or destroy nearly 40 million legally owned brace firearms. Failure to do so could result in possible felony charges – and jail time, for firearms that these citizens, once again, legally own.
The suit also explains how the ATF “waffled” on the topic of pistol-braced firearms for almost a decade, and how even if gun owners were to brace a pistol against one’s shoulder, it would not have to be reclassified. This rule apparently goes against that.
It all ties in with the Biden administration trying to move forward on an all-out ban for assault weapons in the United States – something he did before and vows to do again.
