Gun Group Fights Back Against Department of Justice Motion

Gun Owners of America spokesman Stephen Willeford discusses the actions by the DOJ to try and stop its lawsuit against the ATF.

Even with Donald Trump in office, it seems like the Department of Justice (DOJ) has its own plans when it comes to fighting a particular lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The bureau recently asked for a stay in an ongoing lawsuit against the ATF, brought on by the Gun Owners of America (GOA) in conjunction with the Gun Owners Foundation (GOF). These groups had already seen a victory at the lower court surrounding a request to block the Biden Administration’s “engaged in the business” rule, and clearly the DOJ is intimidated by that.

But the groups aren’t resting easily, as they recently filed an opposition, believing that the lawsuit should stay the course – especially considering its progress.

Erich Pratt, who serves as Senior Vice President for the GOA, noted in a statement, “We’ve already won a preliminary victory in the lower court, and the DOJ’s attempt to now stay the case is nothing but a delay tactic. A stay risks entrenching this case in an endless cycle of bureaucracy, and we’re not going to let that happen. The judge in our case issued a strong preliminary ruling, and it’s time to move forward—no more stalling.”

He added, “We encourage Attorney General Pam Bondi to put the right people in charge of handling these critical cases. DOJ bureaucrats are standing in the way of justice, and it’s time to make sure the right people are held accountable.”

Joining us now to discuss this further is Stephen Willeford, who currently serves as spokesman for the GOA. Stephen is the “hero with a gun” from the Sutherland Springs incident in 2017, which he has since co-written a book about. We welcome him to the show!

Q&A:

  1. So is the Department of Justice intimidated by the progress being made with the GOA’s lawsuit against the ATF? Is that why it requested a stay order, you think?
  2. Tell us more about this “engaged in the business” rule, and why it’s so problematic for gun owners in the United States.
  3. Why do you think the Biden Administration was so determined to hamper or even outright remove the rights of private gun owners in the United States?
  4. With Trump in office – and fully supporting gun owners – could we see more Executive Orders from him to do away with some of the Biden Administration’s silly laws?

  6. Where do you see the battle surrounding gun rights going as 2025 continues on?
  7. You recently wrote a book called A Town Called Sutherland Springs: Faith and Heroism Through Tragedy, revolving around your 2017 “hero with a gun” situation. Tell us more about how this came together, and why it’s such an important read right now.
