Do President Biden and the ATF Have a Case Going After “Ghost Guns”? This Lawyer Doesn’t Seem To Think So

A representative for the Second Amendment Foundation explains why Biden’s pursuit of “ghost guns” isn’t built on legitimate facts.

President Joe Biden and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) have been quite pursuant on “ghost guns” as of late. They’re concerned about how easily they can be bought, and how they can’t be traced without a legitimate serial number of bill of sale.

Kristina Mastropasqua noted in a recent email to The Epoch Times, “It is probable that current trace data significantly underrepresents the number of PMFs recovered in crimes by LEAs due to a variety of challenges presented by PMFs.”

However, Brian Abbas, an attorney with the Mountain State’s Legal Foundation (who are currently suing the government over its) “frame or receiver rule” surrounding these guns, doesn’t believe this is the case.

“All the data shows the 80-percent receivers and privately made firearms are not the problem,” he told The Epoch Times in a new report.

Although Biden and the ATF have touted figures regarding an increase in the use of “ghost guns” with certain criminal acts, Abbas made it clear that increased trace requests don’t automatically equal increased crime.

“A trace is to determine how firearms wind up in the hands of criminals. Just because it was traced doesn’t mean it was used in a crime,” he explained.

“Do (Biden and the ATF) suspect it’s a crime gun simply because it doesn’t have a serial number?”

  1. Why do you believe Biden and the ATF have such a problem with “ghost guns”? Why are they so quick to immediately call them “crime guns” even though they’re not directly linked to said crimes?
  2. Do you believe “ghost guns” serve a purpose on today’s market? Particularly with private citizens who just want to collect these guns?
  3. It seems that the ATF are leaning heavily on the investigation side of things with said “ghost guns.” However, Abbas makes it clear that a majority of them end up stolen. Do you think the ATF’s case holds any water with this counter-argument?
  4. What do you think Biden and the ATF should be doing instead of going after these “ghost guns”? Shouldn’t they be more concerned with the escalating violence in the United States, instead of pursuing private gun owners?
