Confusion In the DOJ: How Is a Nearly Century-Old Gun Law Still Being Upheld?

A spokesman for the Gun Owners of America discusses a certain rule that took effect back in 1934 – and why it’s a problem today.

Even though President Donald Trump has made great strides in moving things forward for private gun owners, there are still certain rules out there that continue to hinder them. Like, for instance, the National Firearms Act of 1934.

This is essentially a federal law that established a tax and registration system for certain types of firearms, ones considered to be weapons of war or used by organized crime at the time. Obviously times have changed, but that rule still has an effect when it comes to certain suppressors, which are used by millions of private gun owners.

During a Peterson case before the Fifth Circuit, the Department of Justice did make it clear that suppressors are protected by the Second Amendment. However, they still believe the NFA’s registration scheme and restrictions, based around this long-standing law, must be upheld.

Attorney General Pam Bondi noted something that eerily resembles what some California anti-gun bureaucrats have said, noting that suppressors are “specially adaptable to criminal misuse.” This leans more into gun control propaganda, however, instead of following Constitutional law.

With that, the Gun Owners of America are pushing for a campaign to do away with laws such as this, simply because they violate what the Second Amendment stands for. A spokesman for the group – either Mark Jones or Stephen Willeford – joins us now to discuss the matter further. We welcome them to the show!

  1. So the National Firearms Act of 1934 was put into effect mainly to curb violence with organized crime, is that correct?
  2. Why has it continued to be kept in place, despite the diminishing of the organized crime that the law was against?
  3. Why are suppressors so important for private gun owners? What purpose do they serve on certain firearms?
  4. Why do you believe Attorney General Pam Bondi continues to fight in favor of the National Firearms Act, especially when it goes against the Second Amendment?
  5. Do you believe Donald Trump could convince the Department of Justice to see his way of things when it comes to the gun rights of private gun owners?
  6. That said, where do you see the conversation surrounding gun rights and red flag laws going as we head into 2026?
