Background Check Blasted Out of New York!

The Gun Owners of America score a crucial victory over unconstitutional background checks. Another day, another legal win over New York for gun owners everywhere, according to Gun Owners of America spokesman Stephen Willeford. The group, alongside the Gun Owners Foundation, recently announced that it has scored a legal victory against New York’s “Concealed Carry Improvement Act,” which has served as a restrictive rule against gun owners everywhere – to the point that it’s even unconstitutional. In a Stipulation of Partial Settlement filed within the United States district Court for the Northern District of New York, State Defendants were left with no choice but to consent to an injunction against its enforcement.  And rightfully so, considering it forced applicants for a concealed carry license to submit a list of former and current social media accounts for the past three years in an effort to confirm “character and conduct.” With that, the Superintendent of the New York State Police is required to make sure that any PPB-3 license application does not include any language requesting social media information. Erich Pratt, who serves as Senior Vice President of Gun Owners of America, noted, “New York’s ‘Concealed Carry Improvement Act’ is a smokescreen. This law has never been about improving concealed carry for law-abiding citizens but instead is a calculated effort to disarm as many New Yorkers as possible. We will continue fighting this unconstitutional law in court, including New York’s onerous location restrictions.” Stephen Willeford, the 2017 “Hero with a Gun” who serves as a spokesman for the group, joins us now to discuss the legal victory further. We welcome him to the show! Q&A: 1.        Why would New York have such a rule in place to require applicants for a Concealed Carry license to provide information on their social media? Were they really that concerned about representation, or was it something else?2.        How badly did this violate the personal rights of gun owners in terms of privacy?3.        Should it be any surprise that the Court forced State Defendants to overturn enforcing this policy, or was it well expected?4.        You’ve often discussed the importance of Concealed Carry (or Open Carry) with certain citizens when it comes to protection.
