A Federal Judge Just Gave Gun Owners a Major Win When It Comes To the ATF Pistol Brace Rule

A spokesman for the Second Amendment Foundation discusses the win, and what it means for private gun owners moving forward.

The ATF has yet another blow delivered to them, as a federal judge has stopped the agency from enforcing its pistol brace rule on millions of gun owners, including members of the National Rifle Association.

Originally, several groups – including the Second Amendment Foundation – battled against the rule, believing that the group’s rule to reclassify the brace-equipped pistols as short-barreled rifles is absolutely unconstitutional. Once the NRA filed a lawsuit, however, the judge saw how serious the matter became.

U.S. District Judge San Lindsay noted that the pistol-brace rule “fails the logical outgrowth test and violates” the Administrative Procedure Act (APA) for short. He also noted how “unlawful” such a rule is to private gun owners.

“The court, therefore, sees no reason why it should not consider this argument and APA claim in ruling on Plaintiff’s Motion,” the Judge continued. “To not do so would be exalt form over substance, particularly since the Fifth Circuit has already determined that this claim has a substantial likelihood of succeeding on the merits.”
