A Federal Appeals Court Has Ruled That States Cannot Ban Guns In Banks, Hospitals or Churches (Guest: Second Amendment Foundation Spokesman)

That said, property owners still have a say in who can carry guns into their establishment.

A Federal Appeals court just dashed the hopes of states that were hoping to keep guns out of certain establishments.

Late last week, said court has refused to allow two states – California and Hawaii – from banning guns in hospitals, banks and churches, deeming that such a ban goes against the Second Amendment. That said, it did note that private property owners still have a say as to who carries a weapon on their grounds – but not the state.

The court noted it was citing a “basic background principle of property law” and that California had no right in instating such bans, or forcing private property owners to post a sign indicating whether or not guns could be carried.

Whether this will discourage these states from trying to re-establish said laws with new wording has yet to be seen.

A spokesman for the Second Amendment Foundation joins us now to discuss the situation further.
