The Criminalization of Pro-Life Activism: The Washington D.C. Case and Its Dangerous Precedents (Guest: Jim Harden)

Guest Expert: Rev. Jim Harden, CEO of CompassCare Pro-Life Pregnancy Centers

Talking Points:

On August 29, 2023, Assistant U.S. Attorney General Kristen Clarke, known for her pro-abortion stance, indicted five pro-life activists including Lauren Handy under the FACE Act and conspiracy against rights. These activists now face up to $350,000 fines and 11 years in prison. The presiding Judge, Colleen Kollar-Kotelly, has a pro-abortion bias, according to our next guest, Rev. Jim Harden, who contends that this sets a perilous precedent against free speech and peaceful activism for pro-lifers.

We extend a warm welcome to Jim Harden, founder of CompassCare pregnancy centers in Buffalo, New York that was firebombed a year ago by pro-abortion activists.

Q&A:

  1. Do you feel these charges are the weaponization of Law since the FACE Act was  originally intended for combating organized crime, but is now being used to suppress peaceful pro-life activists?
  • Jim, you have argued that the FACE Act charges are the American version of Stalin’s Article 58. Can you elaborate?
  • In your opinion, do you feel Assistant U.S. Attorney General Kristen Clarke is being even handed here or does she have political bias in the indictment process, and does her background reveal that she is pro-life or pro-abortion and how do you know this?
  • What is the role of the Judiciary? Can you substantiate your examination of the pro-abortion bias from U.S. District Court Judge Colleen Kollar-Kotelly, who you suggested might be in violation of the third KKK act of 1871?
  • Political Overreach: Let’s look into how the Biden Administration’s Department of Justice may have acted capriciously and illegitimately in these indictments.

The Santangelo Factor: Examination of Dr. Cesare Santangelo’s controversial record and possible violation of federal law.

The Constitutional Angle: Harden questions if Judge Kollar-Kotelly’s actions may place her in violation of 42 U.S.C. section 1983. Discussion on how the trial violates activists’ constitutional rights.

Thomas More Society’s Appeal: Martin Cannon, senior legal counsel, will appeal the case, potentially overturning the Clinton-era FACE Act.

Next Steps: Legal options moving forward and why this case may pave the way to question the constitutionality of the FACE Act, especially after the Dobbs case.

The Human Element: Personal stories of the activists involved and the severe penalties they face for their peaceful protests.

Demand for Justice: The decision will be appealed, and justice is being demanded for these activists who aim to protect defenseless preborn U.S. citizens.
