The debate over pro-life and a woman’s right to abortion has reached a fever pitch in recent months, with advocates on both sides of the issue trying to hit the reset button on national policy.
The Supreme Court set Dec. 1 arguments on Mississippi’s ban on abortion after 15 weeks of pregnancy — a direct challenge to Roe v. Wade. Lower courts have blocked Mississippi’s ban, claiming it directly violates Roe’s protections for pre-viability abortions. In taking the Mississippi case, the Supreme Court’s conservative supermajority signaled its openness to revisit and potentially overturn the landmark 1973 decision that legalized abortion nationwide, with a ruling expected next year. This case is on the heels of the Texas law that went into effect in September that has banned most abortions in the state as early as six weeks into pregnancy.
Our guest to provide additional insight on this matter is Attorney Allan Parker of The Justice Foundation and his client, a woman who, in his Amicus Brief to the Supreme Court, attested that she once was a frozen embryo. She is the first Human Embryo who has filed an amicus brief before the Supreme Court. She’s 22 years old now, and no longer an embryo, proving that embryos are viable and not merely blobs of tissue.

Allan Parker is a former Professor of Law at St. Mary’s University in San Antonio, Texas, where he taught Education Law and Civil Procedure. He was a Visiting Professor at the University of Texas, and studied International Human Rights at the International Human Rights Institute in Strasbourg, France. He taught International Human Rights at the St. Mary’s Institute on World Legal Problems in Innsbruck, Austria in 1992.
Mr. Parker received his J.D. degree with high honors from the University of Texas School of Law in 1979. He was an Associate Editor of the Texas Law Review, a Chancellor, Order of the Coif, and Order of Barristers for his outstanding advocacy skills. He graduated Phi Beta Kappa from the University of Oklahoma with a B.A. in Economics in 1974.

5. What does her life prove that could lead to the reversal of Roe v. Wade?
Roe said that abortion could be banned “after viability”. Viability was defined as “capable of living outside the mother’s womb, albeit with artificial aid.” Her life experience irrefutably establishes that with today’s science, viable life begins at fertilization and thus abortion should be permissibly banned from fertilization and continues until birth if states choose to do so.
