Gun groups and private gun owners secured a huge victory earlier this month. But what follows?
After over nearly a century of unfairness, the National Firearms Act came to an end earlier this month with a decisive victory in Federal court. And while Gun Owners of America spokesman Stephen Willeford is absolutely thrilled with the victory, that doesn’t necessarily mean the fight is over.
- A U.S. Judge issued the landmark decision to end the National Firearms Act in early August, deeming it unconstitutional.
- The National Firearms Act originally taxed on specific weapons, including short-barreled rifles, shotguns and others. But now that it’s out of action, purchases can be made without unfair taxation.
- Though the Act is no longer effective, there is always the possibility that the government could try to appeal.
Back on August 5, a U.S. Judge deemed that the National Firearm Act’s registration requirements were unconstitutional for certain firearms having their taxed reduced to $0. This led to unnecessary fees via taxation that affected thousands of gun owners.

Though the injunction currently applies to certain plaintiffs and customers covered by the court’s order, the Gun Owners of America are currently pushing for the Department of Justice to extend this decision to all Americans – though, at the moment, they remain silent.
This does mark a huge victory for private gun owners and those that believe in the Second Amendment of the Constitution. And while it’s very like that the Trump Administration will not appeal the ruling, there is a belief that the government could try to do it in the future. So while this is still a well-earned victory, the fight isn’t quite over. At least, not yet. Not until everyone benefits from the overturned decision.
