That raises what Harden believes is the real question: If Congress created the law, why are members of Congress demanding that the president unilaterally undo it as a condition for confirming his attorney general?
“The Constitution doesn’t give presidents the authority to erase weaponization statutes they don’t like,” Harden argues. “If Senators Cornyn and Tillis believe the law is flawed, they possess the very power needed to change it. They’re legislators. Passing or repealing laws is literally their job.”
Harden says the standoff exposes a troubling trend in Washington where constitutional responsibilities are routinely blurred for political theater. Instead of introducing legislation to amend or repeal the underlying statute, senators are conditioning confirmation votes on executive action that would raise serious separation-of-powers concerns.
The irony, Harden notes, becomes even sharper in light of President Trump’s criticism that both Cornyn and Tillis previously supported Merrick Garland’s confirmation while now blocking Blanche over a weaponization fund dispute Congress itself has the constitutional authority to resolve.
As a constitutional advocate who has spent years challenging government overreach and defending civil liberties, Harden says this episode illustrates a broader civic problem: Americans increasingly expect presidents to govern by executive fiat while Congress avoids accountability for the laws it enacts.
“It’s not simply about Todd Blanche,” Harden says. “It’s about whether we still believe in constitutional government. Senators shouldn’t be demanding that presidents ignore laws. If they think a law is wrong, they should do what the Constitution requires—change the law.”
