The spokesman for Gun Owners of America explains why a new bill in South Carolina may shift the tide with legal action against gun makers.
Some people have, in the past, taken it upon themselves to press charges against gun manufacturers, believing them to be responsible for whatever violence is taking place in the world. But a new South Carolina bill could very well change the legal action surrounding that.
According to the Gun Owners of America, a new bill has been pre-filed in South Carolina, introduced by Representative Chris Wooten. Known as House Bill 4723, it would prohibit these so-called “qualified civil liability actions” that try to hold firearm manufacturers – as well as dealers and sellers – responsible for a criminal’s misuse of their lawful products.
This is vital, because the group believes that such lawsuits are “bankrupting the firearms industry through lawfare.”
The exact terms of the bill are as follows:
- Protects law-abiding gun makers, sellers, and owners from unfair and politically motivated lawsuits
- Stops anti-gun activists from abusing the courts with lawsuit schemes that place unjustified strain on the firearms industry
- Still allows real lawsuits when there is actual negligence, a defective product, or criminal wrongdoing from the company
- Upholds South Carolina’s Second Amendment rights and the protections in the state constitution
This bill is crucial when it comes to stopping the actions of anti-gun zealots who are out to try and bankrupt these companies and sellers.
