High Court Ignores Danger at Border By Michael Letts

The U.S. Supreme Court just opened up the border for more illegal migrants to enter the U.S.

On Monday, the court granted the Biden administration’s request to not allow wire that the Texas government installed along its border with Mexico, something which the administration should have done itself. Unfortunately, the Biden administration can now cut the wire, along with the state’s right to defend its border from an illegal immigrant invasion.

The three liberal judges on the court along with John Roberts and Amy Coney Barrett vacated an injunction the Fifth Circuit Court put in place that temporarily blocked the U.S. Border Patrol from cutting the wire while the lawsuit is pending.

The Supreme Court is charged with deciding on cases of Constitutional law. Since the Biden administration came to power, many have pointed out that it does not “provide for the common defence, promote the general Welfare” as stated in the preamble of the Constitution.

And while that remains the case here, the justices should have given a closer look to Article 1, Section 10, Clause 3:

“No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”

Most of the time, this clause is only looked at in its relation to compacts, but when you read it, it says “No State shall, without the Consent of Congress… engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”

Can you argue that the United States is not being invaded? During the first three months of fiscal year 2024 (October, November, and December 2023), the U.S. Customs and Border Protection had 682,000 encounters with illegal migrants. Over the last three fiscal years (2023, 2022, 2021), CBP had more than 5.9 million encounters with illegal migrants.

And those are just ones they caught!

How many crossed that the overworked and hamstringed agents didn’t catch? Another 5.9 million?

Yes, we are being invaded by a foreign power.

Are we in imminent danger, so much so that action against the invading force can’t wait?

Hundreds of the illegal migrants encounters were discovered to be on the U.S. terrorist watchlists.

Crime is skyrocketing and resources in liberal cities are being strained. Liberal politicians in these cities, like New York and Chicago, are pointing the finger of blame primarily at their having to take care of illegals in their cities.

This is an imminent threat because it continues to grow as thousands come across the border daily with tens of thousands more heading north to our border.

The first cities to feel the impact were in Texas, New Mexico, Arizona, California and Florida. Those states struggled to deal with the burden of caring for the illegals.

Meanwhile, the federal government did not help, and in fact, hindered the ability of the CBP agents to do their job.

The Department of Homeland Security argued against Texas, saying, in part, the state’s actions prevented border agents from accessing “the very border they are charged with patrolling and the individuals they are charged with apprehending and inspecting.”

No one is arguing that protecting the border is not a federal mandate that the government should be doing. Texas and other states are arguing that the federal government isn’t doing it, so they have to to protect themselves.

Texas Solicitor General Aaron Nielson argued:

“This case began when federal Border Patrol agents began cutting wire fences that, among other uses, helped channel individuals— unlawful migrants and U.S. citizens alike — to a lawful border crossing at a port of entry. Border Patrol began this practice of destroying Texas’s property, according to the district court’s findings, in order to ‘facilitate the surge of migrants into Eagle Pass,’ using boats to ‘literally usher’ people across illegally.”

If something isn’t done, and done soon, the damage to this country will be irreparable.
