The Second Amendment Foundation Provides Its Full Support On Senators Seeking Legal Action Against a New Mexico Governor’s Unconstitutional Gun Ban

A representative for the group explains why the Senators are so concerned over the irrational actions of Governor Michelle Lujan Grisham.

Last week, New Mexico Gov. Michelle Lujan Grisham caused havoc for citizens of Albuquerque by outright banning the ability to carry guns (save for officers of the law). But now, on the heels of six Senators calling for an investigation, the Second Amendment Foundation is speaking up on the matter.

U.S. Attorney General Merrick Garland was sent a letter by Senators Lindsey Graham, Thom Tillis, Jon Cornyn, Tom Cotton, John Kennedy and Marsha Blackburn, demanding that legal action be taken against Grisham for her irrational actions. “By preventing certain New Mexicans from exercising their constitutional rights to carry a handgun for self-defense outside the home, Governor Grisham is violating the Second Amendment, the Fourteenth Amendment, and Article IV of the Constitution. This is a chilling action, and it is imperative that your Department act immediately to show that this kind of unconstitutional abuse will not be tolerated in New Mexico or anywhere else in the United States,” they noted.

The Second Amendment Foundation backed the actions of these Senators. Founder and Executive Vice President Alan M. Gottlieb noted in a statement, “Instead, Garland and the DOJ have remained silent while gun rights organizations, including SAF, had to carry their water by suing to protect the constitutional rights of American citizens. It was us, not Garland and the DOJ, who went to federal court and obtained a temporary restraining order against the governor, and the American public should be asking why.”

He continued, “The fact that Garland and the Biden DOJ have not taken any action is proof positive that Joe Biden has not upheld his oath of office. Furthermore, Garland’s obvious hands-off reaction to the governor’s outrageous direct attack on the Second Amendment clearly illustrates why he was not confirmed by the Senate to serve on the U.S. Supreme Court.”

“Attorney General Garland and the DOJ have been AWOL since this disgraceful episode erupted a week ago,” SAF Executive Director Adam Kraut added in a statement. “There is no small irony in the fact that SAF and other gun rights organizations have once again had to defend the constitution while Garland and his boss have been so busy trying to erode it.”

Q&A:

  1. How much are Grisham’s actions going against the actual Second Amendment? Could legal action continue to be taken if she doesn’t reverse course?
  2. In what way does this violate the rights of U.S. citizens? Mainly with their right to bear arms?
  3. We’ve seen situations in the past where counties and states have tried to ban guns before, only for them to backfire due to an increase in violence or their being overturned by the Second Amendment. Why is it that some governments just don’t want to accept they won’t stand?
  4. If Grisham’s rule is overturned, will she simply find a way to restrict gun purchases or something else? Could she possibly try to seek support from Biden since he’s in a similar state of mind with wanting to ban “assault weapons”?
  5. You’ve noted in the past how effective Concealed-Carry (or Constitutional-Carry) has been, particularly in stopping “active shooter” events. Do you believe that is still the case, and how is your team pushing to get more states to get a closer look at it?
