Second Amendment Foundation Fighting Back Against Maryland’s Gun Ban Case (Guest: Second Amendment)

Ever since it banned semiautomatic assault-style weapons with a recent bill, Maryland has been facing a mountain of backlash from those standing up for the Second Amendment.

Following the U.S. Supreme Court’s constitutional challenge that was sent to the state earlier this month, the Second Amendment Foundation, alongside the Citizens Committee for the Right to Keep and Bear Arms, have filed a supplemental opening brief in an effort to continue its push towards the state’s ban.

In the brief, the group discusses the landmark ruling from the New York State Rifle & Pistol Association vs. Bruen case. It notes how the high court mandated “the only way that a law burdening conduct falling within the Second Amendment’s scope can be upheld is if the government can demonstrate a ‘historical tradition’ of regulations, rooted in the Founding Era, that burdened the right in a similar way and for similar reasons.” 

The statement also makes note that the Supreme Court’s ruling in Bruen “demonstrates that Maryland’s ban on certain semiautomatic rifles is unconstitutional.”

As the case continues to proceed, we’re joined now by a representative of the Second Amendment Foundation to discuss this matter further, along with why it’s so important that everyone continues to possess the right to bear arms.

Q&A:

  1. Why do you believe Maryland is pushing so hard to ban certain semiautomatic assault rifles within its state? 
  2. We’ve seen in the past how such laws are passed, and yet would-be criminals are still able to get their hands on certain firearms and modifiable parts. Does this prove that the ban is ineffective and a general waste of time?
  3. There’s also the argument how Maryland’s ban goes right up against a right within the Constitution to bear arms – the Second Amendment, as your group is named. Even the Supreme Court is against them in this matter. And yet they continue to persist with their case. Why do you believe that is?
  4. There have been many arguments in the past about the effectiveness of concealed-carry, including several active shooter events that have been stopped because of these citizens. Do you believe this would be a more proper solution compared to an all-out ban?
  5. Are you concerned that other states could introduce a similar set of harsh initiatives? Some may be motivated to follow President Biden’s lead in an effort to ban certain rifles and modifiable parts.
  6. If the case does rule in your favor, what will the Second Amendment Foundation do next in its effort to allow citizens to bear arms?
