New York Citizens Living In Public Housing Have the Right To Bear Arms, Judge Proclaims

A spokesman for the Second Amendment Foundation criticizes the actions of the Cortland Housing Authority.

New York has always been strict when it comes to setting up unnecessary gun laws – but the Cortland Housing Authority (CHA) recently took things a step too far when it banned its tenants from utilizing their Second Amendment rights.

As a result, a judge has overturned the decision, permanently barring the group from imposing any kind of firearms ban on its tenants. The decision notes that the group is not allowed to restrict tenants “from owning, possessing, transporting or using firearms for lawful purposes,” according to Judge Glenn Suddaby of the U.S. District Court for the Northern District of New York.

On top of that, the CHA also violated the First Amendment, as it had censored Facebook posts discussing its ban on firearms. Suddaby also ordered them to refrain from doing so.

The CHA reportedly put these rules in place to stop violence that was reaching a “wholly unprecedented” level. However, it clearly went about trying to enforce its rules the entirely wrong way – and will now not have a hand in telling its tenants how to live.

A spokesman for the Second Amendment Foundation joins us now to discuss the matter further.

  1. With concerns surrounding an increase in violence, why did the CHA believe that banning firearms – and social media discussion about firearms – was the right decision to make?
  2. Would citizens want to be armed at a time of increased violence? Just as a matter of keeping themselves and their family safe?
  3. Do you think the CHA went too far when it came to censoring posts on social media surrounding the ban? How heavy of a violation is this?
  4. With this victory, could other housing developments be backing off on trying to take away any crucial rights from its tenants?
  5. New York has always been trying to pass certain gun laws, taking away rights from its citizens. Why do you think that is?
  6. You’ve often discussed the benefit of Concealed-Carry when it comes to fighting against particular criminals, such as “active shooters.” What do you think makes it most effective compared to other solutions?
