Michigan’s Red Flag Law Is Asking For Trouble – Especially When It Comes To Deciding Who’s a “Threat”

A Second Amendment representative explains why Michigan’s new measure could hinder some people in dangerous situations.

Following in the footsteps of Minnesota a few days prior, Michigan Governor Gretchen Whitmer has given final approval for a red flag law. With it, the state aims to keep firearms away from those that are “at risk of harming themselves or others”.

Known as “extreme risk protection orders,” the law will allow family members, police, mental health professionals and other close parties to petition a judge to remove firearms from those they deem a danger. From there, the judge has 24 hours to decide whether a protection order is necessary.

While some believe this could be a good safety measure, it does bring up the question as to whether people will be able to hold onto their firearms, even if a document is filed as a mistake or for personal reasons, such as “revenge.”

Joining us now to discuss this measure is a representative for the Second Amendment Foundation. They are a group that firmly believes in the right for all to bear arms. Their expertise will prove useful for this matter.

  1. First Minnesota, now Michigan. Why are these states trying to move forward on enforcing what they call “red flag laws”?
  2. Do you believe that anyone being able to protest whether someone is a danger with a weapon with very little reasoning is unfair? Even with the judge’s consideration over the case?
  3. What if the person that has their firearm away doesn’t pose a danger, but suddenly gets into a situation where they’re powerless to defend themselves? Wouldn’t that create big trouble for this “red flag law”?
  4. How does this “red flag law” stand up against the Second Amendment? Do you believe that there could be lawsuits in an effort to reverse it?
