Is a Court’s Recent Decision On a Racial Quota Law a Strike Back Against “Woke” Government and Corporate Policies? (Guest: Kevin Stocklin)

The author and documentarian behind The Shadow State discusses his latest article.

In a new article posted on The Epoch Times, reporter Kevin Stocklin discusses a recent decision by a California district court that blocks a state law surrounding a mandate of “racial quota.”

The law, also known as AB979, originally noted that a minimum number of people from “designated racial, ethnic, and LGBTQ backgrounds” were required to have a seat on corporate boards. However, the court ruled that the law “is unconstitutional on its face and Plaintiff is entitled to summary judgment in its favor as a matter of law.”

Michael Bushbacher, a partner at Boyden Gray, representing the plaintiff Alliance for Fair Board Recruitment, said, “The Court made clear that California’s attempts at racial engineering are per se unlawful. The Constitution prohibits diversity mandates in every circumstance.”

He added, “Woke corporations that impose diversity mandates on their own are thus just as liable.”

Edward Blum, director of the Alliance for Fair Board Recruitment, added, “Businesses should appoint board members based on their merit, not on their skin color.”

With many government members and others recognizing the tactics of “woke” businesses, this is definitely a win in their favor. But what happens next? Stocklin joins us now to discuss the article further.

  1. What do you think California officials were thinking when they initially put this law together? 
  2. How do these laws square with Civil Rights laws that have banned racial, ethnic and gender discrimination since the 1960s?
  3. Did the courts leave room for some racial laws if they remedy historic injustices?
  4. This case applies to a state law, but can’t private companies do whatever they want?
  5. Do you believe California will try and appeal the decision?
  6. Could this ruling have an effect in other states as well? How will it likely affect businesses that have instituted racial policies?
