A spokesman for the Second Amendment Foundation explains that there’s much more work to be done in the state.
New Jersey’s state government believed that a ban on AR-15 rifles would be the best answer for stopping gun violence. But a Federal judge reminded them that it’s not a viable solution.
U.S. District Judge Peter G. Sheridan knocked down the ban, noting that it was unconstitutional. “The AR-15 Provision of the Assault Firearms Law is unconstitutional under Bruen and Heller as to the Colt AR-15 for use of self-defense within the home,” he explained in an accompanying memorandum.
“In this court’s understanding of Supreme Court precedent, a categorical ban on a class of weapons commonly used for self-defense is unlawful.”
That said, the Assault Firearms Law does remain in place since other weapons aside from the AR-15 weren’t discussed in the case. Sheridan also agreed to keep restrictions on large-capacity magazines in place as well.
