A Judge Has Dismissed Donald Trump’s Florida Classified Documents Case – and Rightfully So (Guest: Michael Letts)

The law enforcement veteran discusses the decision, and why it’s important to have the right counsel on the case in the first place.

Following the assassination attempt on his life in Pennsylvania over the weekend, former President Donald Trump did receive some good news on the legal front today.

According to Fox News, a Florida judge has dismissed the case against Trump surrounding the handling of classified documents. The big red flag with the dismissal came with the appointing of Special Counsel Jack Smith.

“Former President Trump’s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is GRANTED in accordance with this Order,” U.S. District Judge Aileen Cannon noted in the ruling. “The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution.”

Several of Trump’s allies praised the decision, while his usual critics questioned it. That said, however, Smith’s appointment was the big revolving point of discussion.

Cannon noted, “Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme – the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law.”
