The founder of InVest USA and law enforcement discusses how the Court could stop prosecutions against attendees of the January 6th “insurrection.”
After seeing a number of cases where January 6th “insurrectionists” were charged over their opinions of the 2020 Presidential Election, the Supreme Court appears set to reverse a law that the Biden Administration has been using heavily against them.
According to The Epoch Times, legal experts note that the Supreme Court is ready to knock down 18 U.S. Code Section 1512©, which many believe is being used improperly against those defendants.
It states, “Whoever corruptly (1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or (2) otherwise obstructs, influences, or impedes any official proceeding or attempts to do so, shall be fined under this title or imprisoned not more than 20 years, or both.”
If overturned, a majority of their charges – including ones levied against former President Donald Trump – could be thrown out.
These same experts believe that Biden is utilizing the accounting reform law to charge the January 6th attendees, which the Department of Justice is using to charge people that were merely exercising their First Amendment rights when it came to certification.
Jim Burling, who serves as vice president of legal affairs for the Pacific Legal Foundation (PLF) called said charges “utterly absurd,” noting, “The Department of Justice should get an award for creativity and … [for] how they’ve come up with ways of using Sarbanes-Oxley well beyond what anybody ever thought it would be [used for].”
And while many argue that some January 6th “insurrectionists” are merely getting “what’s coming to them,” the letter of the law must be followed. Joining us now to discuss this further is Michael Letts, a law enforcement veteran with over 30 years of experience under his belt.
