A representative for the group explains why this action is being taken, in an effort to stop the law from taking effect next year.
California is no stranger to bizarre gun laws that go up against the rights provided by the Second Amendment – but this one is just asking for trouble.
Effective January 1st, a new law will require licensed firearms dealers to record and save all video surveillance for one year, and set to record 24 hours a day. Setting up said system could very well be a costly move for many of these store owners – and many gun groups believe it’s violating the rights of those that possess guns.
As such, the group has announced that it has filed alongside other gun groups, alongside their attorneys, a temporary restraining order to prevent the state from implementing what some believe is an “Orwellian” statute.
The group noted that the provisions violate several Amendments, including the First, Fourth, Fifth and 14th, along with the Second.
Our motion for the TRO is direct and to the point,” said SAF founder and Executive Vice President Alan M. Gottlieb in a statement. “We believe it is imperative to prevent this law from being implemented because of the serious constitutional issues at stake.”
“The various tenets of Penal Code § 26806 amount to an egregious violation of several constitutional rights, including free speech, privacy and the right to keep and bear arms,” said SAF Executive Director Adam Kraut. “To impose what amounts to a mass surveillance regime in California is an afront to the rights of citizens across the state.”
