GUN CONTROL JUST WON’T QUIT Constitution Enforcement Falling on Deaf Ears in Chicago (Alan Gottlieb is in Pacific Time)

Image Last year, under the premise of a gun ban in the nation’s capital, the landmark case of District of Columbia v. Heller went to the Supreme Court where the 2nd Amendment’s guarantee of an individual’s right to keep and bear arms was upheld.

It was a major victory, according to Alan Gottlieb, Chairman of the Citizens Committee for the Right to Keep and Bear Arms. But, unfortunately, he adds, it didn’t set the precedent it rightfully should have. And now the battle continues somewhere else.

“Because the (Heller) case concerned the actions of the District of Columbia government, a federal entity,” Gottlieb writes in his organization’s gun-alert e-mail, “the high court was not called upon to decide whether the right bound states and local governments” to the same ruling.

Now, Chicago is trying to apply a similar gun ban—one that, likewise, will come before the Supreme Court—this time via McDonald v. City of Chicago. And yet, Gottlieb goes on to say, even with the odds stacked against the City, the gun-control politicians don’t plan to leave well enough alone. He writes:

“It’s already looking like everyone, on both sides of the issue, anticipates that the Justices will rule that the 2nd Amendment is incorporated through the 14th Amendment as a barrier to local gun bans. Even anti-gunners appear to realize (this), but want the Justices to leave enough wiggle room in their ruling to allow most, if not all, existing gun-control laws to stand . . . This leaves many hard-core gun rights advocates once again demanding, ‘What part of shall-not-be-infringed don’t you understand’?”


At the heart of Gottlieb’s red-flag concern are the President and his overreaching Attorney General Eric Holder who “aggressively detailed the Obama anti-gun agenda in public statements before the Senate Judiciary Committee.” These statements included a national, permanent gun-registration system, a new federal authority to prohibit gun sales to any person on the dubious federal watch list, and a provision allowing the government to confiscate guns from those on the list who possess them.

Bottom line, gun-rights advocates don’t expect the Chicago gun ban to be upheld, but that hardly means the fight is over.
