SHOWDOWN IN CHICAGO Major Gun-Rights Case to Go Before U.S. Supreme Court (Alan Gottlieb is in PST)
This coming March 2nd, a 27-year-old Chicago gun-ban law will stand trial before the U.S. Supreme Court under a challenge brought forth by four Chicago residents, the Second Amendment Foundation and the Illinois State Rifle Association.
Though many on both sides of the contentious gun-rights issue expect the Justices to rule that the Second Amendment is indeed incorporated through the 14th Amendment, thus taking precedent over and blocking any state or local gun bans, Alan Gottlieb, Chairman of the Citizens Committee for the Right to Keep and Bear Arms, is prepared to explain why this is, nonetheless, a paramount case.
“Anti-gunners know the Bill of Rights overrides local laws like this,” says Gottlieb, “and, even though they anticipate the Court will make this ruling, they are still lobbying to have the Justices leave enough wiggle room in their ruling to allow most, if not all, existing gun-control laws to stand.”
Gottlieb’s fear, like that of other gun rights proponents, is that the end result will pave the way for further gun restrictions—even if through similar legal finagling—especially given the current President who has proven willing to break his campaign promise that “lawful gun owners have nothing to fear . . . I’m not going to take your guns away.”
One of the Justices who will rule on the case is Obama nominee, Sandra Sotomayor. She is on record as a sitting judge, ruling that the Constitutional right to bear arms did not apply to the states. Where she comes down on this case will be telling.
At the same time, Gottlieb takes issue with Obama’s overreaching Attorney General Eric Holder who “aggressively detailed the Obama anti-gun agenda in public statements before the Senate Judiciary Committee.” These statements included a national, permanent gun-registration system, a new federal authority to prohibit gun sales to any person on the dubious federal watch list, and a provision allowing the government to confiscate guns from those on the list who possess them.
Bottom line, gun-rights advocates don’t expect the Chicago gun ban to be upheld, but that hardly means the fight is over.
